المسائل الاجتهادية Issues which allow Ijtihad 新加坡

لقد صح عن عمر بن عبد العزيز كما في صحيح البخاري وغيره أنه قال ما تمنيت أن لم يختلف أصحاب محمد صلى الله عليه وسلم It has been authentically narrated of Umar Ibn Abd Al-Aziz, as is in Sahih AlBukhari and others, that he said: I never wished that the companions of Muhammad ﷺ did not differ. فمراده رحمه الله في المسائل الاجتهادية التي لا نص فيها فمراده رحمه الله في المسائل الاجتهادية التي لا نص فيها What he intended, may Allah have mercy on him, is in issues which allow Ijtihad (discretionary judgment) - issues which have no (direct) text (from the Quran or Sunnah) regarding them. لأن المسائل الاجتهادية التي لا نص فيها اختلاف العلماء فيها رفع للقطعية في المسألة (That’s) because when scholars differ in issues which allow Ijtihad, where there is no direct text, it removes absolution of the issue’s verdict. وحينئذ يكون فيه توسعة أما المسائل النصية فالاختلاف على النص شر Therefore, there is ampleness. As for textual matters, differing (on an issue) when a direct text (from the Quran and Sunnah) is provided is evil. ولهذا ينبغي أن يكون الناس متفقون في العمل بالنصوص وإن اختلفوا في المسائل التي لا نص فيها. نعم. Therefore, people should agree on acting upon the texts, even if they differ on issues where no (clear) text is available.
